Federalist #78 deals with Supreme Court and its role in the government. Hamilton discusses the power of the court along with checks and balances. There are four guided reading questions that will help you understand the document.

  1. Describe the function of the Supreme Court as Publius sees it
  1. Identify the opposing views on life terms and powers that Publius anticipates in the document – explain how he addresses the opposition
  1. Identify the two powers the judiciary lacks that make it the weakest branch and explain why they result in SCOTUS being considered the weakest branch
  1. Explain the role the judiciary plays in the system of checks and balances, not only among the branches, but also between citizens and the government
